  • Fact-checking Sam George’s claim of criminalisation of LGBT in parts of America and limited legislative support for LGBT in Europe 

    On Sunday 15th May 2022 Ghanaian lawmaker, Sam George, was a guest on Citi TV‘s Upside Down show. The Ningo Prampram MP is among eight other lawmakers who are pushing for the criminalization of LGBT+ activities in Ghana.

    Whilst speaking about his anti-LGBT+ advocacy, Sam George argued that the subject of homosexuality has not “even been settled” in America and in Europe and wondered why anyone should shove it under the throats of Africans and Ghanaians in particular.

    He went on to make some claims about the LGBT+ activities in US and Europe and the laws in those places that regulate such activities. Some of these claims have been brought to the attention of DUBAWA to be fact-checked.

    The claims are in a short clip that has been posted on Twitter.

    Claim 1: “There are 50 States in America. Only 23 have laws that promote LGBT. [The remaining] 27 have laws that criminalize or fight or restrict the rights of this practice of homosexuality.” 

    The US Supreme Court which is the highest court of the land in 2003 legalized activities of homosexuals. The ruling is binding on all 50 states.

    Verification

    Following a June 2003 ruling by the US Supreme Court, practice of homosexuality became legal in the United States of America.

    In June 2015, the Supreme Court ruled that same-sex marriage is legal across the US. If the court acknowledges marriage between same-sex couples, obviously, it only implies that homosexual activities are deemed legal in America.

    Laws that promote LGBT activities in the US vary from State to State. For instance, whereas New Mexico has a State law that explicitly prohibits discrimination based on sexual orientation and gender identity, Texas State does not

    Unless there are particular metrics that are being looked at, such as Conversion Therapy and Discrimination, it will be difficult to be specific as to the number of states that promote LGBT+ activities, considering that the practice and the acceptance of gay marriage are legal across the US.

    In California, which is deemed one of the most liberal and progressive, there is a rule against blood donation by gay people.

    The US LGBT+ Travel Index 2022 ranks Alaska as the worst state for gay travelers. Despite this status, serving openly in the military is allowed as it is in California and several other states.

    Claim 2: “Even in the 23 [that promote LGBT], 6 of them have recently passed laws that limit the freedoms that have previously been given to them.”

    A number of laws have been passed in a number of states in the US restricting activities of the LGBT+, especially in schools.

    Florida has enacted a law that, among other provisions, censors discussion of sexual orientation and gender identity in the classroom — a type of policy often called “Don’t Say Gay or Trans.” 

    Alabama Governor has also signed into law two bills that ban transgender health care for minors and teaching about gender identity and sexual orientation in kindergarten through fifth grade.

    About 20 other States are said to have introduced bills that would censor LGBTQ-related curricula, materials, student groups, and more.

    Alabama has also voted to ban gender-affirming medical care for transgender youth.

    Some states have also passed bills that ban transgender youth participation in sports. These are Iowa, Oklahoma, and Arizona.

    Indiana Governor has also vetoed a bill banning transgender females from participating in girls’ school sports. 

    South Dakota Governor has also signed an anti-transgender sports bill into law, thus restricting transgender women and girls from playing on school sports teams that match their gender identity in public schools and post-secondary institutions.

    Those are some seven states in the U.S. that have recently passed laws that limit the rights of LGBT.

    American Television Channel, MSNBC hints that 2022 could be the most anti-trans legislative year in the US.

    Claim 3: “When you go to Europe, only 17 have legislation that supports LGBT.”

    Completely False! Data show that 29 of the countries in Europe have legislations that support either gay marriages or some form of same sex unions and the remaining 22 countries have legislations that support LGBTQ activities even though they do not support same sex marriages.

    The European Union considers equal treatment as a fundamental right. In view of that, it has taken several measures to combat discrimination on the basis of sexual orientation and gender identity.

    According to the EU, “since 1999 it has had the power to act in cases of discrimination based on sexual orientation and has since adopted legislation and taken measures to extend legal and social protection for LGBT people.”

    In 2021, a BBC publication listed 30 countries where homosexuality was deemed illegal. There were no European countries on the list.

    Even though same-sex relations are legal across Europe because of EU conventions and treaties, not all European countries have legislation that fully supports LGBT+ activities.

    For instance, even though homosexuality is legal in Turkey, the country does not recognize same-sex marriages, LGBT+ and persons cannot serve in the military, among other limitations.

    ILGA-Europe, an umbrella body of LGBT+ advocacy organisation in Europe, reports that there are gross violations of human rights for LGBT+ people in countries such as Russia, Armenia, Turkey, and Azerbaijan.

    A 2019 data from Pew Research Centre indicates that 18 European countries have passed legislation to accept gay marriage. 

    These include; Austria, Belgium, Denmark, England, Finland, France, Germany, Iceland, Ireland, Luxembourg, Malta, Netherlands, Northern Ireland, Norway, Portugal, Scotland, Spain, and Sweden.

    The data suggests that a further 11 allows for some form of same-sex unions/civil partnerships but not marriage.

    However, in some 22 others, same-sex union of any kind is not legal, according to the Research Centre. Even though these 22 countries do not support same-sex unions, all of them including the Vatican City do have legislations that support LGBTQ activities. For instance in Albania, gay activities are legal except for gay marriage. In Bulgaria too, LGBTQ activities are legal. The same thing goes for Russia and Serbia

    Conclusion

    Sam George’s claim that 23 states in the US have laws that promote LGBT whereas 27 states do not  is misleading as each of the 50 States has at least a rule that limits or restricts the rights of homosexuals – Blood donations by Men Sleeping with Men (MSMs).

    Again, it is not true that homosexuality is illegal or has been criminalized in some parts of the US. 

    Also, his claim that only 17 countries in Europe have legislations that support LGBT activities is also false. 

    However, the MP’s claim that some six states in the US have recently passed laws that limit the freedoms of LGBT persons is true.

  • False; these young men were not flogged on suspicion of being homosexuals

    Claim: Nhyira 104.5FM has posted two videos on Facebook of young men being flogged, with a claim that they are homosexuals.

    Dubawa has analyzed the videos and has found the claim to be false.

    On Tuesday, February 1, 2022, a verified Facebook page, Nhyira 104.5FM posted two 30-seconds videos on its platform.

    In the separate videos which may appear inappropriate or offensive to some viewers , two young men, who were topless, with their arms and legs wrapped around a pillar were subjected to heavy  flogging  in the presence of onlookers.

    The caption given by Nhyira 104.5FM reads, “alleged gay partners flogged mercilessly in public.”

    The two videos have an average of 720.5K views, 2.5K comments, 5.8K reactions, and have been shared 2.4K times.

    Verification

    To authenticate the claim, we took a screenshot and did a Google Reverse Image Search to help discover similar images on the web.

    There were several matching images that came up in the search.

    These included images similar to the video content published on Facebook by Nhyira 104.5

    In a 2021 publication on newsnaira.net, the photo was used among several others to narrate how young people were flogged in Imo State, Nigeria, for taking ‘Mkpuru Mmiri’ drugs. It was also used in another opinion article, published on 774ngr.com, highlighting the usage of Crystal Meth among the youth in Iglo land in Nigeria, and the “unorthodox method to curb the menace.”

    A YouTube video, uploaded in November 2021 contained visuals of young people being flogged for using the drug.

    A naijanews.com publication in November 2021, which used the same image also mentioned the use of the drug and made reference to how young people in Nigeria were flogged to serve as a deterrent to others.

    A Facebook user, Millionzz Icehood, also shared the same videos in a Group. The description for the video indicated that the youth were punished by a vigilante team for drug abuse.

    Another page on Facebook, Ndi Igbo, has several such videos, all related to incidents where young people in Nigeria were flogged as punishment for using the Mkpuru Mmiri’ drugs.

    When DUBAWA contacted a reporter at Premium Times, Nigeria, QueenEsther Iroanusi to confirm whether there are instances where people are publicly flogged for abusing drugs in Igboland, she said: 

    “I spoke to a few friends I have in the South East and whilst they are saying that people who abuse these substances are publicly flogged, they do not know of any case where people were flogged for being homosexuals. There is a high chance that the people who were being flogged in the video were being flogged for abusing the substance and not homosexuality,” she said.

    What is Mkpuru Mmiri?

    Mkpuru Mmiri is an Igbo slang for Crystal Methamphetamine. The drug is described in an article published on punchng.com by Edith Nkem as an “extremely potent and addictive stimulant that affects the central nervous system and several other systems of the body.”

    A November 2021 article on vanguardngr.com indicated that many Igbo communities were “currently facing the dangerous effect of the use of the drug.”

    There is also a publication on allafrica.com highlighting the escalation of the use of the drug among Nigeria’s youthful population.

    Conclusion

    The young men who were flogged in the videos posted by Nhyira 104.5FM could not have been because they were homosexuals. 

  • False! Michael Essien did not lose 1 million followers over LGBTQI post

    Claim: Many news websites say Ghanaian soccer international, Michael Essien lost over 1 million followers on Twitter after making an Instagram post to declare solidarity for LGBTQIs in Ghana. 

    False. Social media indices used to assess the following of Michael Essien on Twitter show that he has not lost a million followers on the platform.

    Many news websites including Daily GuideNetwork, Modern Ghana, GhanaWeb and GhPage claim that Ghanaian soccer international and former Chelsea FC star, Michael Essien has lost over 1 million followers on social media after declaring solidarity with groups demanding equal rights for LGBTQIs in Ghana.  

    Several social media posts such as this and this also made such claims. Some of the publications claim the follower count drop was recorded on Twitter while others said it occurred on Instagram.

    Michael Essien’s post that reportedly led to the mass exodus of followers was published on his Instagram page. It has since been deleted after several backlash by the commenting public. 

    “Ghana supports equality. We see you, we support you. Our LGBTQIA plus community in Ghana”, that Essien shared on his Instagram account,” the post read.

    The claim is curious because, among other things, there are only about 2 million Instagram accounts and 695,000 Twitter accounts in Ghana, according to Hootsuite’s 2021 Digital Report for Ghana and so it appears unlikely that the majority of these numbers will unfollow Essien on his platforms. (Page 48 & 51).

    Currently, Michael Essien’s official Instagram page reports 1.4 million followers while his official Twitter account reports 688,000 followers.

    Verification

    Twitter: Relying on the free Twitter monitoring application provided by SocialBakers, an AI-powered social media marketing company we run a scan on Michael Essien’s personal Twitter page and noticed that his followers on Twitter on 2nd March 2021 when the controversial post was made, did not fall but rather increased significantly compared to previous days. 

    The application recorded at least 560 net new followers. 

    This was a sharp rise in the number of net new followers compared to previous days.

    Conclusion

    Based on the information above, we conclude that the claim that Ghanaian football star Michael Essien lost over a million followers on social media after declaring solidarity with LGBTQIs in Ghana is false. 

  • Fake news headlines suggest the US is giving out free visas to LGBTQ+ persons in Ghana.

    Claim: The United States of America is giving free visas to members of Ghana’s LGBTQ+ community.

    Verdict: False. The U.S. is not giving free visas to LGBTQ+ individuals in Ghana.

    The issue of LGBTQ+ in Ghana has been in the news for weeks following the launch of an LGBTQ+ office in Ghana.

    The claim was being circulated on Instagram and was forwarded to Dubawa for fact-checking. The conversation on LGBTQ+ communities in Ghana has been and is still being discussed widely and, as such, all issues concerning the matter warrant clarification.

    Verification

    Firstly, we subjected the image to Google Reverse Image Search and found that the news source is fake. The frame was traced to photofunia, a site that allows users to edit images and apply picture effects to any image of their choosing within seconds. This can be done at no cost and users have a variety of options to choose from and to suit their purpose.

    This effect has been used for many fake news productions like this Facebook post on Jim Carter and some claimed news reports which Dubawa found to be fake as well.

    Secondly, the claim being made is being stretched out of context. Joseph Biden, the President of the United States of America has, according to a reuters report, stated that US agencies abroad increase efforts to ensure that asylum seekers who belong to LGBTQ+ communities  be given equal access to protection and increased use of referrals to expedite resettlement of vulnerable people, in this case, criminalized LGBTQ individuals and LGBTQ refugees and asylum seekers. 

    In a BBC Pidgin news report, it was also stated that the US will favour LGBTQ+ community members  with resettlement visas, having recognized that such individuals face discrimination or threats in their home countries. As stated in the report, the US Federal Government will take all necessary steps to increase Embassy Priority-1 referrals and also to identify and quickly process resettlement for the highly vulnerable who are in need of protection. Priority-1 referrals are refugee cases that include all cases individually identified and referred to the U.S. Refugee Admissions Program by the United Nations High Commissioner for Refugees(UNHCR), a U.S. embassy or a non-governmental organization.

    We reached out to the US embassy in Ghana and were referred to the Important Note for Current and Future Visa Applicants section of their website. There is no mention of free visas for members of the LGBTQ+ community in Ghana on the site, indicating no change in Visa needs or qualifications as otherwise suggested by the claim.

    Conclusion:

    The U.S. is not giving free visas to Ghanaian LGBTQ+ community members but the country is making plans to prioritise priority-1 referrals.
